False Advertising Lawsuit Focuses on Section 230 Protections: Navigating the Boundaries of Online Accountability

California - 9/6/2023 — Planet Green Cartridges, Inc., a U.S. printer cartridge recycler and remanufacture, filed a $500 million lawsuit against tech giant Amazon. The lawsuit alleges that Amazon has engaged in false advertising and unfair competition by participating in the sale of newly manufactured clone printer ink cartridges that are deceptively marketed as "remanufactured" and misrepresented as eco-friendly recycled products.

At the heart of this legal dispute is Section 230 of the Communications Decency Act, which grants internet companies immunity from legal liability for content posted by third parties. The main issue revolves around Planet Green's repeated requests for Amazon to police its platform and remove sellers falsely marketing and selling their products. Amazon invoked Section 230 immunity claims to any liability to the plaintiffs' claims.
"This lawsuit challenges Amazon's interpretation of Section 230 as the company actively participates in the sale of illicit cartridges, a direct violation of Section 5 of the FTC Act. The evidence presented by my client underscores Amazon's pivotal role in the distribution and sale of counterfeit recycled products, rendering the e-commerce giant accountable for these illicit items," asserts Attorney John Ulin, representing Planet Green.
In 2021, 75% of new sellers on Amazon originated from China, as many manufacturers find it easy to go direct-to-consumers through the online platform (Marketplace Pulse). This broad immunity poses a significant challenge when attempting to hold overseas sellers liable or accountable for unlawful and anti-competitive behavior according to U.S. law.
